In our Divorce Decree it states that my ex-spouse has to cover all three children's healthcare under his policy. Also states that any change then I have to be notified.

I am trying to schedule counseling sessions as ordered last week at court. Come to find out that my three kids have not had any coverage since 28th February 2013!

I heard from my kids that he was let go (again for the 3rd time) so I am assuming that this is round about the same time.

Do I have any recourse?

He has not notified me of these changes, also too, I'm pretty positive that he would have been offered COBRA by his position as he is in medical sales.

This man's arrogance is bloody unbelievable. I wonder what the Judge will say about this??

Argh!! That makes me mad too just hearing it!! In my state, you can only apply for COBRA within 90 days, and it's VERY expensive, but it seems like you just missed the deadline.

Definitely take this to your attorney to see what can be done.. Just another example where they don't see the damage to the children.. ASSHAT!! FTG!!!!!

That's terrible.

I'm working on the decree they gave me and it says that he won't have to cover any health care, now or in the future!!!!!!

He is unemployed now and we are on the state insurance coverage, so I wonder if your state has one, scotslass? We don't pay anything for it. It's basic coverage but I am glad to have it.

I was going to ask my L the same thing because I notice there isn't lingo for penalties.

This decree they used for an example really sucks for whoever it was for, because it was attempting to "share the expenses and no, no alimony given", but I don't know the conditions or reasons for the filing, of course.

Whoever got it got a seriously bum deal.

Anyway, hopefully your L or IC can advise answers to those questions.

FWIW, wne person who was helpful when Perv was in hiding was actually DD's school principal, who is educated in all the local social service programs. She actually has a computer program and can search them and print some applications and info. It was pretty amazing to see.

I've also heard of one divorce scenario where they take away ExH's license (this is an L, to boot!) when things get to a certain point and other scenarios where they don't do a thing.

The child support registry in my state forced X to get coverage. Maybe your state has the same agency.

He just sent me a text that when he lost his health care coverage he took out a catastrophic one for him and the children. With a $5000 deductible.

Of course, once again he did not notify me of these changes. Grrrrrrr

If he only has catastropic insurance, does he have to pay all the doctor's bills 100%?

Scottslass - he just notified you. 3 months late.

In my decree ha has to maintain insurance for the children at the same or better coverage than what was in effect at the time of the divorce. So far so good.

If he is to supply the insurance, that also means he is to cover deductibles and copays, unless specifically stated otherwise. To not be responsible, he will have to have a court order stating that.

Get his insurance cards for the kids and use them. Just for fun, you should have them all go for check ups, dental check ups, your daughter to the OB/GYN, etc.

Trust me, he'll regret ever having catastrophic only coverage when he sees what average doctor's bills really costs HIM.

A bit spiteful? Maybe :) But hey, it's the least you could do for him after all he's done for you.

Personally, my kids are all I have now, and even though the X takes care of them, I cannot stand the thought of them going without basics like health care, food, roof, clothes. They are my pride and joy and I just don't understand your H's lack of care for anyone but himself.
