Just found out the tonight (final divorce court hearing tomorrow afternoon) that STBXWH took out a loan a week ago ... He knew that neither one of us could do these things until the divorce was over. I just don't know what to do. As I want to keep my mouth shut and let the divorce be final tomorrow yet I don't want it to come back and bite me. As in Wisconsin it is a 50/50 marital state and even though I didn't sign for this loan the bank is to notify me (which I haven't received) But I don't know if my name will be on it anyways or what I should do

It's in our administrative orders (which came into effect when I filed the divorce) that neither of us are allowed to incur debt and hold the other one responsible for it.. My POS took out a loan at a jewelry store a month after I filed (for his fling with the twink he was cheating on MOW with), and I am in NO WAY responsible for that..

I would mention it to your lawyer, and I'm no expert, but I would venture to guess that you can't be held responsible for it..

I'm pretty sure he lied (whats new) to the loan company that he is already single or divorced or if he didn't do this I should receive a letter disclosing the loan, which could be delayed because of the forwarding to my new address. In any case, I am just going to keep quiet for the hearing today to get the divorce finalized. When and if I ever receive a letter of notification I will go after him and the bank that gave him the loan to make sure I am not liable for this loan.

I just want to be done being a thousand miles away from him just doesn't seem to be enough on some days ...

I would go to the bank TODAY and get it cleared up. By the time he gets word of the loan being turned down you'll likely be finished with court. And besides, he can bring it up in the courtroom and you can affirm in front of the judge that you didn't agree to the loan and they'll rule in your favor.

Please don't let fear of a potential continuance put you on the hook for this. You very well COULD be held liable for the debt if you don't get it squared away before or during your court date.

He has already had the loan dispersed to him ... and come to find out out that it was through one of those quickie loan places.

As far as going there I am already a 1000 miles away living in another state. There are no lawyers involved in our case and I have read the divorce papers over and over all night: "Any debt not listed shall be the responsibility of the party who incurred the debt."

So there is not much I can do without the letter to confirm the loan as he would just lie and say there isn't one.
