I still feel that stbx is mentally unstable but since I haven't been around him nor have the children, I'm basing my opinion on his past and recent passive-aggressive antics.

Right now, his paychecks are not garnished for child support but it is in our temporary court order. At the end of June, he deposits into our joint account $xxx.60. $0.60 over. I assumed he made a mistake and was to lazy or shame to transfer $0.60 back to his account. Well yesterday, he transfers $x11.97. That's $11.97 over the amount.

Now that it has happened twice (this never happened since we started this arrangement), it makes me wonder what he is up to. His last antic was in June ~ he filed a false theft report claiming I stole his fire extinguisher and keys. So what's it going to be for this month??? Any ideas?

I can't say what he's up to, but given what he's done before, I would suggest keeping/printing the statements, and anything else you have (if any more detail is available for the transaction beyond the statement) so that if he does pull something in the future you have your documentation ready to go.

Huh. Interesting. He might be setting himself up to say "ZOMG, but I always pay MORE than I'm required to!! This is unfair, I'm a victim,waahhhh! You don't understand my life!!!!" But the state views anything over the agreed upon amount as a gift and it doesn't go towards future support payments, so the joke is on him. Just keep track of it

Are you guys serious??? I've never read about that fact in the bazillion books I've read on divorce! I just left the extra in the joint account. I didn't want him to accuse me of {{{gasp}}} theft ... again !!

Never thought of that. Not in my rational thinking mind but I don't know about him.

I did hire a criminal defense attorney and good thing I did because stbx placed the value of the items at $300 therefore making it a class c felony. He's a cop so he knew what he was doing by claiming the worth at $300.

As of now, the detective is not turning it in to the prosecutor but the case will stay "active" for three years. Luckily I have a video security system in case the fire extinguisher miraculously appears in my garage.

The most upsetting thing about that whole mess is that there wasn't anything I could do to counter the false report. My criminal defense attorney stated that at least now he is creating a "paper trail" (of stupidity).

Check with an atty because it might be different when its a private arrangement vs managed through the state, but I'm pretty sure I'm correct. However, with such a loose canon I'd err on the side of paranoia and not touch it.

Check out your state laws. Not every state views overpayment of CS a gift.

X made an overpayment in 2009, when CS was modified due to eldest being 18. It was one payment made AFTER the modification went into effect. The state paid the amount and reduced his obligation by the amount at the end of the scheduled payment. I should have been receiving Alimony until Sept of this year... but it ended in June due to his overpayment in 2009.

Check your state... they aren't all the same.
