Just moved back to NY after a 23-year absence. Got into a minor fenderbender in a parking lot this morning. Bummer, but not a huge deal (I hope! My new employer expects a clean driving record.)

I was pulling through into a parking spot--two front-to-back spaces were open. The car next to me decided at that moment to pull out (she was also facing forward) and took a hard right-right at me. I accelerated slightly and pulled to the right also in an attempt to avoid her but she hit me and scraped along the driver side of my car from the driver's door to the beginning of my left rear quarter panel.

She asked if I thought we should call the police; having written insurance in NY for many years before moving, I told her it wasn't necessary because there were no injuries, and it was private property. We exchanged insurance info and both called our insurance carriers at the scene.

I just got a call from a police officer taking an accident report. I questioned the need, but he said the other driver wanted to make a report. He raked me over the coals about my explanation, saying things like 'her car could not be going SIDEWAYS' and basically calling me a liar. I explained that the only way I could have avoided her was to throw my car into reverse, which I don't think I could have effected quickly enough, so I tried to avoid her by moving forward & to the right. Even if I just stopped, she would have crashed into my front quarter panel because she vered into my space (cutting across what she assumed was an empty parking space rather than pulling forward then turning right.)

He was a dick. I normally love cops but he pissed me off royally. Fuck him.

Welcome to NY

Always always call the cops, so its on record. Now she can claim her side of the truth.

The thing is normally the police won't respond to private property if there are no injuries. They won't even take a statement over the phone. My paranoid guess is she knows someone in the PD. Bleh.

A lot of insurance companies are looking for ways to avoid fraud. A police report helps to validate the claim. At least that's what the police on Florida tell me😏

I am relieved you weren't hurt. Is hoping the karma bus pays her a visit out of line?

Oh that sucks. I'm sorry to hear that, but I'm glad your not hurt. Did you take pictures at the scene?

Sad in AZ posted 8/11/2013 15:01 PM

Yes, I have pictures but that won't prove anything, because she backed off after she hit me. Neither one of us discussed what happened; we just exchanged insurance info. I even lent her a pen .

I wrote insurance for 25 years; I even supervised a fraud unit. I take this very seriously. My estimation of the accident was that it was a simple accident and fault did not have to be assessed; it could be shared equally.

Is there anyway you can check if there were any security cameras aimed where you were parked????
