Is it considered contempt of court if he is not paying my spousal support the way it was worded in the divorce decree?
He has paid me my first two by check. In the decree it states either by electronic transfer or payroll deduction. He told me he won't do either.
Just feeling like he should follow the letter of the decree, but don't know if I should pursue it or not.
THanks for any input.

If I were you, I would just start using payroll deduction. Then, there is never a need for you to discuss the payment, or wonder if you'll get it.

And, you don't need to tell him you're doing it or talk it over with him. It's in your decree. In my opinion it makes things much simpler.

Ex was supposed to pay the spousal support on the 1st of every month. I'd typically get it between the 7th & 10th. It was a hill I chose not to die on. Otoh, child support was done through payroll deduction and handled by the state, so I got that regularly every week and was able to plan around not getting the spousal support on the 1st.

Oh, and ex set me up as a bill payment in his online banking. I'd get the check from his bank, not him. I suppose I could have insisted on electronic transfer, but then I would have had to give ex my banking info, and well, that's none of his damn business. So again, the date I got the spousal support check was not the hill I was going to die on. Now, if I hadn't gotten the check at all, then I would have been going to battle.

One time my X asked me for my banking info so he could set up direct deposit. I told him me must be crazy because there was no way I was doing that. He looked sad and said "Don't you trust me?"

soveryweary, you have to decide if this is a hill you want to die on. He IS paying SS, just not specifically the way specified in the court order. If you take this to court, you may end up with a judge that simply amends the court order to allow payment by check.

Thank you all for your responses.
It's just he pays at least 3 weeks late and this last check I had to threaten contempt of court.
I agree, I'll just wait and see how the next few months go.
He's pissy because I blocked him from texting or phoning me.

I do payroll and enter all kinds of garnishments.
I've never seen one for spousal support.

But I'm thinking if you have a decree stating such you might just be able to give it to his payroll dept and see if they will process it - cut him out of the loop.

Or, ask the court that made the decree how you can get the "via payroll deduction" option rolling.

You can send the court orders to his employer, return receipt requested, they have to honor a court order.

NW was in charge of sending my checks for a year. They never arrived on time. It was a hill I NEEDED to die on. When he took me to court to reduce CS, his petition was denied. I took the opportunity to get an income deduction order in place.

XH/NW were royally pissed that I took control for paying me from them! I was able to breathe a huge sigh of relief. everything was on time from then on. Once the payments started going thru the state I was able to set up electronic payments directly to my account. XH never had my information after that... another sigh of relief!
