ANyone?? Ok, posting for a dear SI friend here. So, to clarify... Has anyone had the OW or OM show up in court to testify against BS and then after the fact ask that their name be redacted or stricken from the records and documents?? (just cause she wants it and cause I guess there are some things she said/did that society might not think are appropriate). Yes, we are talking about a custody/divorce case...not a murder here. Just asking. ANyone??

I did not know you could have it redacted. Why would she do that? If it is a spousal custody case, even with name stricken, her identity would be known. That really does not make sense.
I do have a friend whose XH showed up ready to testify, with documentation, that she had been unfit. My friend showed up with witnesses to his parenting failures and her PI who tracked the XH carrying on with OW in front of both their children. Guess who got total custody? He got three weeks each summer and one weekend a month.

The only reason the court will redact a witnesses name (they will never strike it) is if a) the witness is a minor or b) the witness has reason to fear for their safety (e.g. testifying against the mob or a very high profile case). This is rarely granted - a judge won't do it just because someone is embarrassed about screwing someone else's spouse.

I mentioned the OMs name when my X filed the restraining order, and I fought it in court. His BS believes that is why he is being denied a judgeship. I feel really bad about that one.

I think both sides might have to agree to seal some records...never heard about redacting someone's name. Why didn't she think about that before she said what she said, anyway? If she didn't want the publicity, why didn't she just refuse to testify for her affair partner?? Seems kinda' dumb to me.
