WS was served yesterday, we've been separated in house, he was with OW last night. My lawyer said I have the right to change the locks while he's gone, he now thinks he can come home and continue to live here. I told my kids he moved out and I just can not live with him while he's doing this! He's a very sick man. He plans to meet me at house soon and I don't know how to get rid of him. My dad is going to be there with me, but shit, why won't he leave???? The emotional abuse is destroying me

Hmmm, if the lawyer says you can lock him out, why don't you?

I did but he is demanding to get back in since I haven't been granted sole use of the home yet

JLS0320, I am not a lawyer (nor do I pretend to be one on TV), but you can follow your lawyer's advice.

I'm not trying to tell you how to manipulate the situation, but if you are honestly feeling at all threatened (physically or emotionally), you may have grounds to keep him out of the house. You have to understand that you have alot of power in this situation to keep yourself from harm.

I'm not sure what the worse thing that could happen could be, but it's likely a misdemeanor that your lawyer could help you fight.

Not to make this about me, but I don't know why some WS's don't leave. It seems like most do - but it appears you and I won the lottery because mine won't leave either and it is infuriating at times.

Whew, he pretty much picked his crap up off my porch and left, thank goodness! My dad was here so that may have helped and we never went outside. He's broke and has no place to go, oh well! Maybe OW will take him in lol

Wow! I'm so jealous!!
Mine won't leave, his attorney advised him not to move out so he comes and goes as he pleases leaving destruction in his wake.
My girls know he's with 'her' yet crave his attention when he's home.
My home is not a comfortable place to be...he can't leave soon enough...

Before I was awarded sole possession of the house, my attorney advised me that after I changed the locks, and if he shows up disrupting everything, to call the police. Even though technically he can come in, tell the police he's been gone for a while and him coming back is disrupting the children and the house. Basically explain to the police the situation. They will likely talk to him and tell him to leave.

I'd make sure you get an emergency motion going for sole possession. That's what my lawyer did for me with all his bull he was pulling.
