I make a good living in my own right and just wondered if I asked for maintenance, how would that be calculated?


Me: 44/WH (SA): 49
M: 24 years 3 kids over 10 yrs old
EA/ PA Dec. 2009 -Divorce pending

All states have the formula posted somewhere on their websites. They presume you make at least minimum wage and work 40 hours. In some cases they consider your living expenses. The length of your marriage is also taken into account.

My state has no formula. The amount of spousal support--if any is even awarded--depends on the length of the marriage, the ability of the recipient to earn a living (i.e., age, health, work experience), the ability of the payee to afford the support, and any other special circumstances.

In a few states, lifetime support is the norm for a long-term marriage with a stay-at-home mother/wife. In many other states, a few years of rehabilitative support is the norm.
