Just got back from court. I thought I would be divorced today, but fuckwhad X is accusing me of financial mismanagement and her life insurance is holding everything up. Since she has cancer she is trying to control how the insurance will be used if she passes. Originally it was her mother would be the trustee. Then her AP. Her cousin didn't want anything to do with it (one family member with her head on straight). Then it was she wants part of it to go to her parents, and her brother. She really cares about the kids, doesn't she.

It's frustrating that I had to stand there and be accused of mismanagement, when it was she who threatened to divorce me if I didn't adopt a child with her (after I told her it would be financially difficult for us). It was she who wanted the 25k car instead of something less expensive. It is she who has her AP taking out all of his assets and putting it into a house for them. And I'm the one mismanaging? Gaaaaaaah. I want to be divorced!

I think in her mind, mismanagement must mean "he's not doing things my way!" I'm so sorry. ((((kg))))

Next is meet a financial advisor who is going to decide how much a trustee would need to release in some predetermined schedule so that I would have what I need to care for the kids. If I don't go that route, then i could take it to trial and the judge said she would not be fiddling around with a trust, and most likely I would be made sole trustee of the insurance for the benefit of the kids. But she wouldn't give us a trial date, which indicates she wants us to figure this out without her. I don't want to take it to trial because I want to be divorced sooner than later and it would be more expensive (talk about mismanagement). And then we are applying to take it in front of a minimal issue judge (retired) who will make the decision. This is a separate program for cases that have minimal issues left to resolve.

and

I know how you feel about hoping/planning/assuming you'd be divorced. I was there two months ago. I feel so frustrated for you, kg201.
