User Topic: Getting your name of the Debit before D is final

Don't you ever feel as soon as you turn over a new leaf on a positive note STBXWH lays something negative on you?

I am moving back home to another state. It has been difficult to try and find an apartment from this far away but I found a great place that is being held for me (just with my deposit alone) until the beginning of June. I am so excited but trying to keep it to a minimum to be respectful and keep the calm during the in house separation until I move.

But sure as shit! STXWH comes home this week whining about how unstable his job is ... Now I'm afraid as in our D papers (court date 7/2013) he is to take over all debit, I gave him the house, there is no CS to be discussed or alimony ... Now unstable job and I want to find a way to get my name off of everything before I leave and the D is final ...

Can this be done? Has anyone been able to remove their name from bills etc before the D was finalized? If so how?

For some things it is easy, for others it is next to impossible.

For credit cards where he is the primary card holder, simply call the company and asked to be removed as an authorized user. You can tell who is the authorized card holder by who the bill is addressed to. For cards where you are the primary card holder, then you are out of luck unless you can convince stbx to transfer the balance to a card in his name.

For bank loans, auto loans, and mortgages, the only way to get your name off is for him to refinance the loan in his name.

For car leases, you are out of luck. You are stuck with that until the lease ends.

For utilities, you may be able to call and get the company to change the name or they may require that he do it and also require a deposit from him. It all depends on the utility.

One final note, the credit card companies and banks do not care who was assigned debt in a D. They have no obligation to respect that. They will come after anyone who is on the loan in order to get their money.

Thank you for your reply Dreamboat! I am going to take care of what I can ... STBXWH is just too unreliable to take care of any issues (always has been) This is just one more step I have to fix for me.

Today is our 25th anniversary and eliminating one more worry from this mess, by getting my name off of everything I can right now, will be the Happy Anniversary gift to myself!!

Also a note on the credit cards: If you are on as a JOINT account holder you will not be able to remove your name. Some credit card companies only allow authorized users, but a lot still do put people on as joint account holders. In that case please you are equally responsible.

And if it is YOUR debt that HE is taking on (as in the debt is it your name) the only way it can be taken out is by balance transfering/ refinancing, etc.
