So a couple months ago WXH informed me we were being audited on our state taxes from 2009 because we didn't file and he was going to pay his share of the $1400 due. Well I'm pretty certain we did file and received a refund of $335 that year, but one of the two accounts we had that year is now closed, and I would have to pay to dig up the statement saying we got a refund. Regardless, according to our W2s we paid in enough that even with standard deduction we would still qualify to get $82 back. So I submitted the W2s and the audit has been cancelled. Yay!

Now here is the tricky part, WXH as primary will be receiving a letter notifying him of the cancellation and instructing him to file to receive the refund. Seeing as he is such a take charge stand up guy, I'm sure he will be contacting me to take care of this.

If we do file we could still get $82-335 back from the state, but I really believe we already received it so I don't really feel it is owed to me, also it would require increased contact with WXH which is

I should just leave well enough alone on this one and let WXH sort it out right?

I'd have the 2 of you mutually agree to hire an inexpensive CPA to spend a couple hours and handle it for the both of you. Honestly, that way he can do the communication with you separately and you can also make sure everything is done exactly right so it won't come back to haunt you.

So at best you would get 1/2 of $335? Doesn't sound like it's worth it.
