User Topic: Child support and childcare

How does this work? If we divorced I would return to work and childcare would be a big expense. Is this considered separately from child support?

If you negotiated ths issue would you mind sharing the outcome? Especially if you stayed home before the divorce.

Many times childcare is a 50/50 shared expense. It is normally considered apart from child support. As with most things, you can try to factor in the cost of childcare into child support, but that's not easily done and he'll fight it. Also, with shared expenses that normally means you pay it all up front and then pray to God he reimburses you for his portion.

in my case, he is responsible for 50 percent of childcare. Paid separately than CS. However, I have to pay childcare up front, and then bug him for reimbursement. I'm going to have to take him back to court if he doesn't pay me soon, he owes me over $1,400 in child care costs. It's just another part of him being irresponsible.

Depends on how your state calculates child support. In my state the formula for child support actually includes child care costs. You can usually find the formula for your state on line with a calculator that you can use to figure out what the CS will be.

You can also negotiate additional spousal support for a set amount of years in order for you to get back in the work force.

In my state, CS is a calculated number based off of both our incomes. (at the time of D, I was a SAHM, so for CS calculations, they assumed I worked a 40 hour/wk job at minimum wage.)

I submitted what childcare was going to cost me based off of working that 40/wk job and half of the cost of childcare was added to his CS amount.
