It's been a long time since I've been back here! Long story short, my ex served me with child support mod papers last week. He makes $44,000 a year more than I do, in the past 6 years hasn't taken the 40% of his time sharing and now wants to nickel and dime me over $300. He has no debt except his $1300 a month mortgage in which his roommate pays $500. Yeah it's not about getting back at me. Bastard. Thanks for letting me vent guys :)

It might be time to play hardball. Is CS calculated on the % of time he has the kids? If so you need to talk to your L or the CS agency and look at recouping the difference.

I may have reached a point where I'd piss on him if he was on fire.... eventually!!

Yes my CS is based on that plus expenses like daycare and that's what went down in cost. It seems no matter what these idiots will do anything just to make thing difficult

Time to play hardball indeed. If you have documented the fact that he has NOT been spending his 40% with the children as agreed then merrily march yourself right into court or the CS agency and watch as the judge/agency orders his dumbass to pay even more child support to cover the fact that he is not honoring his 40% time commitment.

ETA: check with your lawyer first to make sure you have everything you need.

if the roommate is not on the mortgage - could be :)

Yep to everything and then see about making him pay for any attorney fees for this due to the fact it's his fault for not taking the kid(s) on his time.
