I have a friend who is being dragged through the system by her deadbeat x. He obtained emergency custody by lying and she was not notified. He's paid ZERO cs for 14 years. My question is this: what should her attorney ask in her interrogatories? She's asking for 401k, ira, bank statements, checks, employment history, liens, real property, judgements, work history. Anything else? Help, please!

Just HOW stupid do you think I am, exactly?

How the heck does someone who hasn't paid CS in 14 years get emergency custody?!

The only thing I can think of is additional income (from renting out a room, etc) My X's Firstwife owned a duplex, which I found out from a quick zillow search, and we found out she had a renter. Made a huge difference in her income.

Still, the lawyer representing my friend is my daughter, a brand spanking new attorney. My friend's x is a SOCIAL WORKER! He and the wife are cray. He filed this due to my friend losing her job and having NO money. My daughter is representing my friend pro bono. She's already put in for cs modification, to raise it from $40 a week, which he never paid to begin with. Owes her $30,000 plus co pays. She's filing next for a lump sum judgement on arrearages. Then, filing with DA for criminal complaint for what he back owes.

I've got no advice, but I'll be holding your friend AND your DD in my thoughts. Sending strength and mojo.

How did he pull off having a hearing when she was not properly served?

You might also want to ask for tax filings also.
