I deleted my "secret" email accounts immediately before Dday and the text messages right after I got each one...deceptive, I know.

My question is, is there a way to go to my cell phone and email providers to get those emails and texts ? Subpoena? No idea how that kind of thing works, however, BH has stated he wishes he could have had access to them, "black and white proof," if you will.

Appreciate any help on this.

I know an attorney can subpoena text logs but I'm unsure about emails.

I too deleted everything after Dday. Not to hide my deeds, but as an "OMG...I need this slug completely out of my life ASAP" thing. In the end, QS was glad he didn't read them. He has a photographic memory and he didn't want those words seared into his mind forever.

The week after Dday, I was able to print out the text logs which listed who texted whom and when...

And I hear what you mean about things getting seared into a SOs memory...I myself struggle with that and wouldn't wish it on anyone, especially a BSO.

If AP was a "contact" in your phone, you can go to contacts and select "history" which will show texts that were deleted. (I think I just heard everyone who is lurking just pick up their phone) Usually those texts are only saved for a finite period of time.

Deleted emails from an office server can be rescued via the back up servers and buying your IT guy lunch, but if you had a gmail account or other web based similar kind, once it's deleted, I'm pretty sure it's gone forever.

Whether or not the content of text messages is still available depends on a number of things. You will always be able to get a copy of the log showing messages were sent and received (may have to be done by an attorney via subpoena). BUT, all cell providers have their own policies for how long they hang on to the content of the messages themselves. For example, Verizon says they delete all content within 30 days I believe.

I know that there are data recovery programs that may be able to recover some of the deleted data. My BH used some of them for my phone. It is worth looking into that.

Digital information in a Gmail account (or yahoo etc) might not be easily accessible to you personally. It might require legal assistance to obtain that information. The truth is, nothing erased is gone forever. That information may still be stored by the service provider. You should reach out to them and ask them what their policy is. It will also be located in their privacy and end-user agreement.

Google and Yahoo both state that if emails have been placed in the trash and deleted then they cannot retrieve them. My guess is that the other providers would be doing about the same thing.
