I can't believe how long ex wife has been able to get away with this.
I hope you get what SO's DD wants tomorrow.

Tonight is SO's night with L, he pics her up from school at 4pm and brings her to our place for homework then gymnastics from 6-8pm.
Apparently mom paid a visit to L at school today where L told her in no uncertain terms that she has not changed her mind and that she wants to live with her father.
Hopefully this is enough for mom to realize that dragging the child to court would NOT be in her best interest.
Fingers crossed!!
Thanks for the mojo ya'll!

SO is on his way to court at 9am. I am on standby 30 minutes away at home (just 1/2 mile from the school) so I can check L out if the judge decides she wants to speak with L in person.
On the advice of his atty, SO made a video last night of L reading her signed affidavit and stating her wishes. He also spoke to ex and she conceded over the phone that she would settle on the matter of custody of L today in court.
Thanks again for all the awesome mojo! SI mojo has never let me down.

****UPDATE****
It's official, SO now has custody of L!
The remaining issues will be addressed after the first of the year to give his ex time to finish the class she started this week and to obtain gainful employment. Apparently the judge was appalled at the length and the amount of spousal support so there is no doubt he will reduce it significantly after the first of the year. WooHoo!!!

We've both been grinning ear to ear all afternoon.
I haven't told SO that it was SI mojo that worked so well in his favor today. It really was, it could have gone so much worse. Let me explain...
SO makes more money now than he did when they entered into their final divorce agreement so mom was expecting child support for 1 child to be about the same as for 2, therefor her income would not be affected.
The judge that was supposed to hear the case today was out or replaced or whatever...but the judge sitting in ALWAYs imputes income from wife in determining child support. His ex fought it tooth and nail and would not agree to impute income on the child support worksheet so it was left to the judge to determine. He said "anyone can make minimum wage", so that's what they used. He was not happy that SO has been given the shaft for the past 3 years and that ex wife has sat on her ass and squandered her time and SOs money. She has had ample time to go to school and obtain employment but she waited until THIS WEEK to start a dental assistant program.
Her boyfriend and her parents were there today and apparently the bailiff was disgusted by their comments and attitude. He commented to SOs atty that his ex was nothing but a money grubber and her entourage was toxic.
SO feels so vindicated and I am so happy that he has custody of L and her life will now be much simpler with us.

I cheered when I read that your SO has custody. I'm so happy for L that she won't have that drama to deal with on a daily basis.
To L: follow your dreams you sound like a put together young lady despite the trials you've gone through.
Kudos for supporting her and helping her along in her own advocacy.
