I am talking to an attorney tomorrow. My WS told me he wanted a divorce when I backed him into a wall and demanded the phone and hotel records. Also the phone records are from a company he doesnt work for anymore.

Yes, an attorney can subpoena those records. Of course, the owners of those records can fight it.
