Also, check your state labor laws. States can adopt their own laws as long as they are at least as restrictive as the FLSA, and some states do add more stringent requirements. For example, that is why a few states require OT for more than 40 hours per work week as well as for more than 8 hours in a work day (for non-exempt employees). In those cases state law trumps federal law...
