Getting my deposit back....

Okay... so I meet with my landlord on Friday to walk through the duplex and discuss my deposit. I spent most of the day Sunday scrubbing the refrigerator out (it is now spotless)scrubbing counters and cleaning the tub, sink, and toilet in the bathroom...mopping the bathroom and kitchen floors and even sweeping the floors in the house place including the basement. I got rid of all trash and even had my dad caulk up any holes in the walls.

I read the lease agreement and have read up on the laws that state that they can't keep your deposit due to "normal wear and tear" and he told me not to paint over the baby jungle mural in her bedroom or the green that I painted in the kitchen because the new tenants were delighted by what I had done and want to keep it the same. He told me to meet him this Friday and "just keep the place clean."

Are there any concerns that I should have that he may try to keep my deposit (wholly or partially)? He has been kinda cheap and whenever I have had minor issues with things that were issues prior to me moving in that he needed to fix....he would always drag his feet. I was in the place for almost 2 years and was never late with a payment and he told me he hated losing me as a tenant when I put in my notice.

I'm just concerned about this conversation and am going to go take pictures during lunch today (just in case) and have my dad meet me there for the walk through (which I have a legal right to be there for).

Just curious if I should be concerned or if I am just being a worry wart (which is typical of me!) My dad said the place looked "move in ready" as far as he was concerned! Better than when it was showed to me!

Maybe over thinking. But if you have LL's email or can text him, I would just get written confirmation of the paint stipulations. If he changes his mind you have no proof what he agreed to.

You should be fine. Some places will have a mandatory cleaning fee if you don't get the place professionally cleaned but they will let you know in advance.

You're good. Your LL may be a bit lazy, but sounds like he will abide by the landlord tenant laws (which, in Virginia, are quite clear).

I had to go to small claims to get our deposit back once. The landlords were batshit crazy and abusive.

Judge Judy slammed them for not acknowledging that we were married (they kept calling him "her boyfriend"), forced them to apologize, and made them pay all costs and interest.

It was awesome.

If you have pics and your dad with you, you'll be fine.

If not, then go to small claims. You've made your best efforts to deliver the place back the way you found it. Nobody will penalize you for that.

Yeah...today I went back and swept up again and took pictures of it after it was cleaned. I think it looks nice. I will miss that place. I just hope he makes this easy on me. I need every penny of that money back. But, I will fight him for it if I have to!

Prior to DD, we moved about every 18 months for over 10 years, and rented in all but one location. If you put elbow grease into spiffing up the place, leaving it as you'd want to move into it, you're good.

We only had one time where there was a tussle over our deposit -- when we were living outside DC in MD -- and that was a case of the landlord trying to pull a fast one (obviously, my opinion; however, every other landlord had raved about how wonderfully clean we'd left his/her property). There was some sort of municipal board to which we were able to file an appeal; ultimately the landlord had to return our money ( ).

If you took photos, did you have something to 'date' the picture (like a newspaper)? (It's not critical, it's just my a-retentive side showing through... )

I hear you about needing all of your dollars back!

The only thing I can think of that he might try to hold against me is that I had DirectTV installed and they put up a satellite on the premises... and I guess if he nit picks that he could say that since the lease says that no modifications should be made without his permission he could be a dick about it.... I don't know.

I'm so nervous.....I meet with him today. I could totally be a jerk too and say that he owes me 11 months at a current federal reserve bond discount rate of 6% (1% below the 7% rate) over the time my lease which was up on March 2013 which equates to about $37.67 additional on top of my security deposit which is also explicitly expressed in his lease agreement..... two can plan the nit pick game if he goes there!!!!
